Tithe Apportionments – Agreement

This is a full transcription of the Agreement for the Commutation of Tithes in the Parish of Waters Upton, as confirmed by the Tithe Commissioners on 22 April 1837. The pages are part of a document held by The National Archives at Kew (part of Piece 29, Sub-piece 328). Capitalisation of words (or not, as the case may be) and punctuation (or lack of) follows the original. Words written in a larger size for emphasis in the original are presented here in bold.

Please note that there are numerous discrepancies between the sizes of the land holdings given in this document, and those given in the apportionment schedule which follows it; I have noted them in [square brackets] below and also provided links to the relevant sections of the schedule.


Apportionment of the Rent Charge in lieu of Tithes in the parish of Waters Upton in the County of Salop.

Whereas an Agreement for the Commutation of Tithes in the parish of Waters Upton in the County of Salop was on the twenty second day of April in the year One thousand Eight hundred and thirty seven confirmed by the Tithe Commissioners for England Wales of which Agreement with the Schedule thereunto annexed the following is a Copy:-

Provisional Articles of Agreement for the Commutation of Tithes in the Parish of Waters Upton in the County of Salop in pursuance of the Act for the Commutation of Tithes in England and Wales made and executed at a meeting duly called and holden and adjourned from time to time and holden by adjournment at the Talbot Inn at Wellington in the said County of Salop on the twenty sixth day of January in the year of our Lord One thousand Eight hundred and thirty seven and since perfected according to the provisions of the said Act by and between the several persons Owner of Land within the said Parish of Waters Upton by whom or by whose Agents duly authorised in that behalf these presents are executed and the Interest of which Land Owners in the lands of the said Parish of Waters Upton is not less than two thirds of the Lands therein subject to Tithes of the one part and the Reverend Richard Corfield Clerk Rector of the said Parish of Waters Upton and Owner of all the Tithes as well great as small thereof of the other part It is by these presents Witnessed that at the said Meeting it hath been and is mutually agreed upon by and between all the said parties in these presents in manner following that is to say that the Annual sum of One hundred and forty one pounds and ten shillings by way of Rent Charge (subject to variation as in the said Act provided and subject to the other provisions therein contained) shall be payable and paid to the said Richard Corfield as Rector of the said Parish of Waters Upton and Owner of the Tithes thereof and to his successors instead of all the Tithes as well great as small of the Lands of the said Parish of Waters Upton (subject to Tithes including Tithes of Glebe the Rent Charge in lieu of which it is hereby agreed shall be fixed at the sum of Five pounds in respect of the Rectorial or Great Tithes of all the Glebe Lands of the said Parish of Waters Upton and One pound and ten shillings in respect of the Vicarial or small Tithes of the Glebe of the said Parish of Waters Upton and which sums it is hereby agreed shall be apportioned exclusively upon the said Glebe Lands) and instead of all Moduses and Compositions real and prescriptive and customary payments payable in respect of all the Lands of the said Parish of Waters Upton or the Produce thereof a summary description of which lands is contained in the Schedule hereunto annexed or hereunder written:–

In Testimony whereof the said Parties to these presents or their respective Agents thereunto duly authorized in their names and on their behalf have to these presents subscribed and set their respective hands and seals.

Schedule to the above Article of Agreement containing a Statement of all the particulars required by the said Act to be set forth or otherwise requisite for the purposes of the Agreement:-

The whole of the Parish of Waters Upton aforesaid contains by Estimation Seven hundred and thirty two acres two roods and twenty-one perches of Land Statute Measure:-

The whole quantity of the Lands of the said Parish of Waters Upton which are subject to the payment of any kind of Tithes is by Estimation seven hundred and thirty two Acres two roods and twenty-one perches Statute Measure and such Lands and the names of the respective Owners thereof and the proportional sums at which such Lands respectively are rated to the Poor are as under-written that is to say:-

Mr John Dickin is the Owner of several Messuages Cottages Outbuildings Gardens and Closes Pieces or Parcels of Arable Meadow and Pasture Land containing together by Estimation Three hundred and eighty one Acres two roods and eight perches [382 acres, 2 roods, 21 perches on the apportionment schedule] statute measure in the several occupations of himself and his Tenants John Turner, Thomas Suker [= Shuker], Joseph Wilkes, Thomas Lloyd, Thomas Bates, Thomas Dodd, Mary Evans, John Matthews, Elizabeth Atcherley,  William Pidgeon, Robert Birch, Samuel Nickliss, Thomas Cureton, James Ridgway, Mary Lloyd, Ann Lloyd, William Harper (Bank) and William Harper (Casbitch Lane) and rated to the Poor at the aggregate sum of Two hundred and nineteen pounds and twelve shillings. Mr Thomas Whitfield is the Owner of several Messuages Cottages Outbuildings Gardens and Closes, Pieces or Parcels of Arable Meadow and Pasture Land containing together by Estimation One hundred and sixty five acres three roods and twenty eight perches [160 acres, 3 roods, 26 perches on the apportionment schedule] of Statute Measure in the several occupations of himself and his Tenants Richard Edwards, John Moore, Samuel Nickliss and Ann Pritchard [plus, on the apportionment schedule, John Titley and Rev Wright Willis] and rated to the Poor at the aggregate sum of Ninety three pounds sixteen shillings and sixpence. The Heir of Devisee of Sarah Allen who is lately dead [named in the schedule as Trustees of the late Richard Allen] is the Owner of a Messuage Outbuildings Garden and several closes pieces or parcels of Arable Meadow and Pasture Land containing together by Estimation Forty-seven Acres [47 acres, 21 perches on the apportionment schedule] Statute Measure in the occupation of Charles Allen and rated to the Poor at the aggregate sum of Twenty six pounds eleven shillings and sixpence. William Machin, George Pritchard, Samuel Nicholls and Sarah his Wife, Susannah Boycott, Henry Clayton and Ann his Wife and Thomas Anslow [on the apportionment schedule, only Samuel Nicholls is named] are Owners of a Messuage Outbuildings Garden and several Closes Pieces or Parcels of Arable Meadow and Pasture Land containing together by Estimation Forty Acres three roods and six perches [40 acres, 2 roods, 2 perches on the apportionment schedule] Statute Measure in the occupation of Edward Anslow and rated to the Poor at the sum of Fifteen pounds and ten shillings. The Most Noble George Granville Duke of Sutherland is the Owner of two Messuages Cottages or Dwellinghouses, Gardens and several Closes Pieces or Parcels of Arable Meadow, Pasture and Wood Land containing together by Estimation Twenty acres one rood and twenty-nine perches  [20 acres, 1 rood, 38 perches on the apportionment schedule] Statute Measure in the several occupations of Thomas Matthews, William Morris, John Titley, and Harriet Woolley and rated to the Poor at the aggregate sum of seven pounds. Joseph Cooper is the Owner of a Messuage Gardens and Land containing together by Estimation Seven Acres three roods and thirty-eight perches Statute Measure in the occupations of Ann Lloyd and John Lloyd and rated to the Poor at the sum of Six pounds nine shillings and ten pence. William Pitchford is the Owner of a Piece of Pasture Land called Rodway Moor containing by Estimation Six Acres One rood and six perches Statute Measure in his own occupation and rated to the Poor at the sum of Two pounds ten shillings. [Go to relevant section of the apportionment schedule]

Thomas Matthews is the Owner of a Messuage or Dwellinghouse Gardens and two Closes Pieces or Parcels of Land containing together by Estimation Five Acres three roods and thirty-one perches [6 acres, 6 perches on the apportionment schedule] Statute Measure in his own occupation and rated to the Poor at the sum of Six pounds twelve shillings and sixpence. William Icke is the Owner of a Messuage (called the Swan Inn) Garden and Land containing by Estimation Five Acres and three roods [5 acres, 2 roods, 22 perches on the apportionment schedule] Statute Measure in his own occupation and rated to the Poor at the sum of Five pounds and ten shillings. Robert Atcherley and George Hampton are the Owners of two Messuages or Dwellinghouses, Gardens and several Crofts of Arable Land containing by Estimation Three Acres and three roods Statute Measure in the occupations of James Gregory William Griffiths and rated to the Poor at the sum of Six pounds ten shillings. Robert Atcherley is the Owner of a Cottages Garden and Close of Land containing by Estimation two roods and thirty-six perches Statute Measure in the occupation of himself and Thomas Bennett and rated to the Poor at the sum of Ten shillings. [Included in the section for Atcherley and Hampton on the apportionment schedule which gives the measurement as 5 acres, 1 rood]

William Felton [Thomas Felton on the apportionment schedule] is the Owner of a Messuage Garden and several Closes of Land containing by Estimation Three Acres and twenty two perches Statute Measure in the occupation of George Barnett and rated to the Poor at the sum of Five pounds ten shillings. Joseph James is the Owner of a Messuage, Garden, and several Closes of Land containing by Estimation Two acres and two roods [1 acre, 3 roods, 20 perches on the apportionment schedule] Statute Measure in the occupation of Thomas Matthews and rated to the Poor at the sum of Three pounds. Elizabeth Dickin is the Owner of a Messuage Garden and one Close of Land containing by Estimation Two Acres and two roods [2 acres, 2 roods, 6 perches on the apportionment schedule] Statute Measure in the occupation of John Titley and rated to the Poor at the sum of One pound. William Fleming is the Owner of a Messuage Garden and one Close of Land containing by Estimation Two Acres and Five perches Statute Measure in the occupation of Robert Blantern [2 acres, 22 perches occupied by Richard Hughes on the apportionment schedule] and rated to the Poor at the sum of One pound and ten shillings. Thomas Clay is the Owner of a Piece of Meadow Land containing by Estimation One acre three roods and three perches [1 acre, 3 roods, 12 perches on the apportionment schedule] Statute Measure in his own occupation and rated to the Poor at the sum of One pound sixteen shillings and eight pence. Matthew Davies is the Owner of a Messuage Garden and Five Closes of Land containing by Estimation One acre and three roods [1 acres, 2 roods, 36 perches on the apportionment schedule] Statute Measure in his own occupation and rated to the Poor at the sum of Five pounds and ten shillings. The heir or Devisee of Ann Evans who is lately dead [named in the schedule as John Felton] is the Owner of two Cottages and Gardens containing by Estimation thirty four perches Statute Measure in the occupations of John Williams and Thomas Felton and rated to the Poor at the sum of ten shillings. The Representatives of the late Richard Jones [named in the Schedule as George Jones] are the Owners of two Cottages and Gardens containing by Estimation Fifteen perches [14 perches on the apportionment schedule] Statute Measure one in the occupation of Samuel Tudor and the other void [occupied by James Ridgway on the apportionment schedule] and rated to the Poor at the aggregate sum of One pound. The whole quantity of Land subject to Tithes within the said Parish of Waters Upton which is cultivated as Arable Land (including the Arable Glebe Land) is by Estimation Five hundred and forty seven acres three roods and four perches Statute Measure.

The whole quantity of Land subject to Tithes within the said Parish of Waters Upton cultivated as Meadow or Pasture Land (including the Meadow or Pasture Glebe Land) is by Estimation One hundred and eighty three Acres and fourteen perches Statute Measure.

The whole quantity of Land subject to Tithes within the said Parish of Waters Upton now cultivated as Wood Land is by Estimation One acre three roods and three perches Statute Measure.

There is no Common Land within the said Parish of Waters Upton.

The under mentioned Moduses or Compositions real of prescriptive or customary payments are payable instead of the under-mentioned Tithes of the said Parish of Waters Upton and the under mentioned Lands and Tithes respectively are covered thereby (that is to say)

The prescriptive or customary payments of Three halfpence for every Cow and Calf a penny for every barren Cow and four pence for every Colt are made to the said Richard Corfield as Rector of the said Parish of Waters Upton instead of Tithes for the same Cattle and the whole of the Lands of the said Parish of Waters Upton and such specific Tithes thereof are covered by such payments.

There are not any Lands in the said Parish of Waters Upton exempt from Tithes.

The Glebe Lands of the said Parish of Waters Upton which if not in the hands of the Owner would be subject to Tithe amount by Estimation to Thirty two acres and two roods the whole of which belong to the said Richard Corfield as Rector of the said Parish of Waters Upton and are rated to the poor at the sum of Thirty pounds and the Tithes of the said Parish of Waters Upton are rated to the Poor at the sum of Sixty-two pounds twelve shillings and sixpence.

Now I William Wyley Junr. of Admaston in the County of Salop having been duly appointed Valuer to apportion the Total Sum agreed to be paid by way of Rent Charge in lieu of Tithes amongst the several Lands in the said Parish of Waters Upton Do hereby apportion the Rent Charges as follows:-
