Note: John Austin was not of Waters Upton, but Waters Upton is referenced in press notices relating to his bankruptcy as his mother lived there (his brother Edward did too).
WHEREAS it hath been represented, that I JAMES JONES, of Leegomery, in the Parish of Wellington, Farmer; asserted in the Public Room, of the Lion Inn, at Wellington, on a Market Day, that Mr. John Austin, of Longdon, Miller, immediately after he became Bankrupt, conveyed by Night three Waggon Loads of Corn from his Grainary, at Longdon, to Waters Upton, (where his Mother resides), and that I met the Waggons on the Road, and cut open one of the Bags of Corn, in order to be satisfied of the Contents. Now I do hereby declare, that the whole of the Charge represented to have been made by me is Groundless, and that I did not at any Time meet or have or ever had any Reason to suspect that any Corn, Flour, or other Property, hath been privately or fraudulently removed or concealed by the said Bankrupt. THE Creditors who have proved their Debts under a Commission of Bankrupt, awarded and issued forth against JOHN AUSTIN, of Longdon-upon-Tern, in the County of Salop, Miller, Dealer, and Chapman; are desired to meet the Assignees of the said Bankrupt’s Estate and Effects, on Saturday the 13th Day of September next, at Eleven of the Clock in the Forenoon, at the House of Robert Lawrence, the Lion Inn, in Shrewsbury, in the said County; to authorise the Assignees either to commence an Action at Law, for recovering the Sum of 200l. and Interest, secured by Bond to the said Bankrupt, or to accept a Composition for the same; and also to consider and determine upon the most advantageous Way of disposing of an expectant Interest in the Sum of 200l. payable at the End of 8 Years, or thereabouts, from this Time, in Case the Term or the Lease under which a certain Farm, at Water’s Upton, is held shall be then unexpired; and also to assent to, or dissent from, the said Assignees commencing, prosecuting, or defending any Suit or Suits at Law or in Equity, for recovering any other Part of the said Bankrupt’s Estate and Effects; or to the compounding, submitting to Arbitration, or otherwise agreeing any Matter or Thing relating thereto, and on other special Affairs.

NOTICE is hereby given, that John Davies, of Waters Upton, in the county of Salop, Innkeeper and Maltster, has by indenture, bearing date the 17th day of April, 1855, conveyed and assigned all his real and personal estate and effects, except his necessary wearing apparel, unto John Jones, of Wellington, in the said county, Maltster and Hop Merchant, his heirs, executors, administrators, and assigns, according to the nature and tenure thereof respectively, in trust, for the equal benefit of all the creditors of the said John Davies, executing the said indenture. And notice is hereby further given, that such indenture was executed by the said John Davies, on the day of the date thereof, in the presence of, and such execution was attested by, Charles Wall Hiatt, of Wellington aforesaid, Solicitor, and John Cressy, of Waters Upton aforesaid, Grocer’s Assistant; and that the same indenture was executed by the said John Jones, on the 18th day of April, 1855, in the presence of, and such execution was attested by, the said Charles Wall Hiatt; and the said indenture now lies for execution by the creditors of the said John Davies, at the office of George Marcy, Solicitor, situate in Wellington aforesaid.

Thomas Henry Blantern, of Forebridge, in the parish of Castle Church, in the county of Stafford, Journeyman Butcher, having been adjudged bankrupt under a Petition for adjudication of Bankruptcy, filed in the County Court of Staffordshire, holden at Stafford, on the 13th day of August, 1868, is hereby required to surrender himself to Mr. George Spilsbury, the Registrar of the said Court, at the first meeting of creditors to be held before the said Registrar, on the 29th day of August instant, at ten of the clock in the forenoon precisely, at the County Court Office, Stafford. BANKRUPTCY COURT.—WEDNESDAY. […]
RE WOOLLEY.—The bankrupt, who lives at Litch [=Sitch] Lane, Waters Upton, is a labourer, and was formerly a butcher. His statement of affairs showed gross liabilities amounting to £144 4s. 9d., at which they were expected to rank. The only assets was the sum of £10 deposited for costs of the petition, and the deficiency amounted to £134 4s. 9d. The bankrupt, who was examined by Mr. Frank Cariss, admitted that for years he had been insolvent, and had got into the hands of money lenders, from whom he had never been able to free himself. His business as a butcher fluctuated, and he was always in debt, but continued trading nevertheless in the hope that things would improve. He was now a farm labourer. Heavy doctors’ bills were accountable in a measure for his impecunious position.—The examination was adjourned. […]

Re Woolley.— Bankrupt lives at Sitch Lane, Waters Upton. He was formerly a butcher, and is now a labourer. His statement of affairs exhibits gross liabilities amounting to £144 4s. 9d., the whole of which is due to 32 unsecured creditors. The only assets is the sum of £10 deposited for the cost of the petition, the deficiency being, therefore, £134 4s. 0d. The debts are made up as follow:—Cattle and meat purchased, £58 10s. 1d.; money lenders’ claims, interest, and costs, £42 16s. 6d.; other cash loans, household, and personal accounts, £13 3s. 8d. The bankrupt stated that his present position was the result of loss in business as a butcher, heavy doctors’ bills, and getting into the hands of money lenders. The examination was formally adjourned.

UNPROFITABLE FARMING IN SHROPSHIRE.
WATER’S UPTON FARMER’S DISASTROUS ENTERPRISE.
At Madeley County Court Offices, Wednesday, before Mr. Registrar Potts, Henry James Jones, farmer, Lower House Farm, Waters Upton, appeared for public examination in bankruptcy. He was represented by Mr. S. B. Dean. Debtor had stated his liabilities to be £315 3s. 5d. and the assets £48 2s. 11d., leaving a deficiency of £257 3s. 5d. His failure was attributed to sickness in family, losses in cattle, and bad seasons.—Replying to Mr F. Cariss (official receiver), debtor stated that he had been used to farming all his life, and 12 years ago, when he was 20 years of age, he took a small holding at Soudley, near Market Drayton, with a capital of £200, which was quite sufficient for the stocking of the holding, with a little to spare. He remained there for six years, and did fairly well, but as there was not sufficient scope for his enterprise, and he was living practically an idle life, took the Lower House Farm at Water’s Upton, the acreage of which was 70, and rent £100 per year. He inspected the farm before he took it, and also had the opinion of an experienced friend, and he felt confident at that time that he would be able make it pay. When he took the farm he had capital, in money and stock, amounting or £600, but that included two loans of £100 each which now formed part of the claims against his estate. Subsequent events proved that he had made a mistake, and he began to lose money almost from the commencement, owing to bad seasons and losses in crops and stock. His one idea was, however, to recoup himself, and he wished to redeem his invested capital, or he would have left the farm two or three years ago. One half of the land was arable and the other pasture. He had grown barley, oats, rye, carrots, mangolds, potatoes, and so forth, and had also reared stock. He had lost on the farm 11 head of cattle, two horses and a colt, 16 sheep, and one sow, which he considered were worth altogether about £200. He constantly called in veterinary surgeons, and the county inspector and the police had visited the place, but no infectious disease could be traced to account for the death of the animals, which was generally said be due to internal inflammation, the cause of which could not discovered. Last year he calculated that had lost £50 on oats, and the potato crop was also a failure. He had also had considerable sickness in his family. He had paid his rent with fair regularity until the last occasion, when, feeling that he could not meet the demand, decided to file his petition. He did not approach the landlord in the matter, nor ask for an extension of time, as he thought it was hopeless make a further attempt to on.—The examination was closed.

A WELLINGTON CLOTHIER’S FAILURE.
A meeting of the creditors of John Warden Owen, clothier and outfitter, carrying on business in Duke-street, and having a private residence in King-street, Wellington, was held on Wednesday afternoon, the Charlton Arms Hotel, Mr. E. A. Clarke represented debtor’s wife.—Mr. P. Cariss (Official Receiver) stated that the debtor, who was 32 years of age, formerly carried on business in the Market Square, Wellington, but in 1905 he removed the whole of his business to a shop in Duke-street, which he himself had erected out of money obtained on mortgages, which still existed. The debtor did not keep such books as were usual in business concerns, but from time to time his accounts were audited by a Manchester firm of accountants, and in February, 1902, these showed a credit balance of £371, but in October, 1903, this had dropped to £93, and the auditors pointed out that debtor’s mode of carrying on business was unsatisfactory. The total debts for which proofs had already been lodged were over £3,000, and the estimated value of the assets was £1,735. Debtor became overdrawn at the bank, and they refused to advance him further loans. He was pressed by other creditors, and he left Wellington on the 14th September, ostensibly for the purpose of attending a friendly society conference at Huddersfield, and had not been heard of since. Debtor’s accounts indicated a turnover of about £4,450 per year, but they had not reached that amount since he had left the town. The wages bill was about £12 per week.—A creditor pointed out that the profit on a turnover of £4,450 would be at least £1,200, and he could not quite see how he had got rid of that money, and at the same time be so extensively in debt.—The Official Receiver said it was exceedingly difficult to say what debtor’s expenses really were, because he had not kept proper accounts, but the wages would amount about £600 per year, and the bank charges and interest on borrowed money would run to about £100 per year.—It was decided that debtor should be adjudged a bankrupt, that a committee of inspection be appointed, and that Mr. F. Wormlersley, accountant, Manchester, be the trustee.

MISSING WELLINGTON TRADESMAN A WARRANT ISSUED. On Wednesday, at the Madeley Bankruptcy Court, before Mr. Registrar Potts, Mr. F. Cariss (Official Receiver) mentioned the case of John Warden Owen, tailor and outfitter, Duke Street. Wellington. The debtor, he said, had absconded, and left the country. A creditors’ petition was filed against him, and receiving order made on October 3rd. The first meeting was held on October 14th at Wellington, and it appeared at the meeting that the liabilities were upwards of £3,000, and assets were then estimated at £1,700. But there would probably be shrinkage in the assets, which would probably be £1,000. Mr. Womersley, chartered accountant, Manchester, was appointed trustee and the estate passed out of his (Mr. Cariss’s) hands as trustee into the hands of Mr. Womersley. The public examination of the debtor was fixed for that day, and notice to that effect had been posted by registered letter to Mr. Owen’s last known address. The bankrupt was not in attendance. The Registrar gave instructions for Mr. Owen to be called.—This was accordingly done, but there was no response. Mr. Cariss then applied for a warrant for the arrest of the debtor, which was granted.

A SALOP FARMER’S AFFAIRS
£1,095 OWING TO HIS FATHER.
George Henry Phillips, farmer, The Lower House Farm, Waters Upton, near Wellington, attended Shrewsbury Bankruptcy Court for his public examination.
According to the summary of his statement of affairs, gross liabilities were estimated at £2,695 15s., liabilities expected to rank £1,553 10s. 4d., and the deficiency £1,110 15s.
Examined by Mr. F. C. Ormrod, Official Receiver, Phillips said he had served in the R.A.F. as an aircraftman, but his father purchased him out in 1925, as he wanted him to assist on the farm.
In 1928 he married and set up for himself at a farm at Buildwas. When he married he had £10 of his own. His father paid £80 for his ingoing and provided him with a considerable amount of stock, something over £500 worth. These items were included in the £1,095 now owing to his father. He also owed his father-in-law £50.
At Buildwas he made a financial success. In 1932 he went to a larger farm at Waters Upton, but did not get on very successfully there, because he had dry seasons and heavy losses in stock. After two years he went to Lower House Farm.
